  • Some products and links on our site are provided by independent affiliate partners
  • We may earn a commission on purchases made through affiliate links at no additional cost to you
  • We are not the manufacturer, warehouse operator, or direct handler of all products listed on our site

3. Affiliate Products & Third-Party Sellers

CROPTIRE BARNYARD partners with third-party affiliate programs and independent sellers (collectively "Affiliate Partners"), which may include but are not limited to major retail platforms and independent vendors.

We are not a party to any transaction between you and an Affiliate Partner. When you click an affiliate link and make a purchase through a third-party platform or seller, you are entering into a separate agreement directly with that Affiliate Partner — not with CROPTIRE BARNYARD.

CROPTIRE BARNYARD expressly disclaims all liability for:

  • Fraud, misrepresentation, or deceptive practices by any Affiliate Partner
  • Intellectual property infringement by any Affiliate Partner
  • Any recalls, safety warnings, or regulatory actions related to affiliate products
  • Shipping delays, lost packages, or fulfillment errors by Affiliate Partners
  • Return, refund, or warranty disputes involving affiliate purchases

All disputes, claims, refunds, and legal matters related to affiliate purchases must be directed solely to the respective Affiliate Partner. CROPTIRE BARNYARD has no obligation to intervene, mediate, or resolve such disputes.

4. Limitation of Liability

To the fullest extent permitted under California law and applicable federal law, CROPTIRE BARNYARD, its owner(s), officers, employees, contractors, and agents shall not be liable for any:

  • Direct, indirect, incidental, punitive, special, or consequential damages
  • Loss of profits, data, revenue, or goodwill
  • Personal injury or property damage related to product use
  • Damages arising from reliance on information on our website
  • Any damages exceeding the total amount you paid to CROPTIRE BARNYARD in the 90 days preceding the claim

California Civil Code § 1542 Waiver: You expressly waive the protections of California Civil Code § 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or releasing party."

CROPTIRE BARNYARD provides its website and services on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • Any affiliate product meets your expectations or legal requirements

6. Indemnification

You agree to indemnify, defend, and hold harmlessCROPTIRE BARNYARD and its owner(s), employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Any dispute arising under these Terms shall be resolved through binding arbitration in the State of California, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive any right to a jury trial or to participate in a class action.

Either party may seek emergency injunctive relief in a California court of competent jurisdiction to prevent irreparable harm pending arbitration.
